Terms & Conditions of Trade – Construction Services

1. Quotations
All quotations are valid for 14 days unless otherwise stated. Prices may change after this period due to supplier, labour, or operational cost increases.

2. Price Adjustments
The Contractor may adjust pricing if costs increase due to factors beyond reasonable control including fuel price rises, supplier increases, labour shortages, supply chain disruptions, government directives, pandemics, war, natural disasters, or similar events.

3. Variations
Changes to the scope of work requested by the Client or required due to site conditions will be treated as variations and may incur additional costs and time.

4. Payment Terms
A deposit may be required prior to commencement. Progress payments may apply. Final payment is due within 7 days of invoice unless otherwise agreed.

5. Late Payments
Overdue invoices may incur interest at 10% per annum. The Client is responsible for any debt recovery or legal costs incurred.

6. Right to Suspend Work
The Contractor may suspend works if payment terms are not met without liability for delays caused by such suspension.

7. Delays
The Contractor is not liable for delays caused by weather, supplier issues, labour shortages, equipment failure, government restrictions, or other events outside reasonable control.

8. Site Access & Safety
The Client must ensure safe and reasonable site access. Delays or additional work caused by restricted access or unsafe conditions may incur extra charges.

9. Unforeseen Site Conditions
If hidden structural issues, underground services, hazardous materials, or unsuitable ground conditions are discovered, additional work required will be treated as a variation.

10. Materials Ownership
All materials remain the property of the Contractor until payment is received in full.

11. Subcontractors
The Contractor may engage qualified subcontractors to complete parts of the works where required.

12. Limitation of Liability
To the maximum extent permitted by law, the Contractor’s liability is limited to the value of the services provided.

13. Acceptance
Acceptance of a quotation, payment of a deposit, or allowing work to commence constitutes acceptance of these Terms & Conditions.
